Strengthening the AMP system to improve compliance with the Canada Labour Code

Ineffective enforcement of the Code and widespread employer violations are leaving many federally regulated employees, particularly truck drivers, without protection from deteriorating wages and working conditions. The Federal Government is trying to make AMPs (Administrative Monetary Penalties) an effective enforcement tool, but AMPs have been significantly under utilized. It is our position that for the AMP system to serve its deterrent purpose, the Labour Program should also continue to improve on other gaps in the enforcement system such as the following:

  • Remove barriers to the Labour Code complaint process;
  • Increase proactive and expanded inspections and reduce delays in enforcement;
  • Significantly improve collections efforts for compensation orders and AMPs; and
  • Close legislative gaps that help employers get away with wage theft.
