These submissions are made on behalf of the Workers’ Action Centre (WAC) and Parkdale Community Legal Services (PCLS). To improve working conditions and combat wage theft in the construction industry, Ontario needs a liability framework that is expansive and adequately resourced. It is our submission that holding contractors and intermediary subcontractors jointly and severally liable for the unpaid wages owed by their subcontractors is crucial to creating a culture of ESA compliance in the construction sector and will specifically address the crisis of employee misclassification in the industry.
