Submission to the Targeted Second Phase Consultations on Building Canada Strong for All, Powered by Canada’s Workers

These submissions by PCLS and WAC focus on non-unionized, low-wage, and precarious workers under Part III of the Canada Labour Code. We address a number of consultation questions regarding paid medical leave and wage theft enforcement. We strongly oppose adding administrative burdens, such as frequent sick notes or attestations, to the 10-day paid medical leave.

Regarding wage theft, we expose systemic non-compliance, misclassification, and unpaid work hours in federally regulated industries like banking and trucking. We offer several recommendations for proactive deterrence, such as the following:
– Extending complaint timeframes to two years;
– Implementing triple damage awards; and
– Establishing statutory definitions for regular pay and deemed work time.
